Elections Canada has been informed that duplicate voter information cards have been printed and mailed by mistake to some registered electors, who are instructed to return their card to their local Elections Canada office.
That said, we’d like to take this opportunity to reiterate that it’s illegal for permanent residents living in Canada that are not Canadian citizens to vote.
To vote in a federal election, you must be a Canadian citizen, be at least 18 years old on election day and prove your identity and address. You must also be registered to vote.
Additionally, when you register, you must declare or confirm your citizenship.
Therefore, a citizenship declaration has been made, at one point or other, for all individuals registered in the National Register of Electors as part of the registration process, including in a consent question on federal forms (i.e. CRA tax return, Canadian citizenship application). In other words, before casting a ballot, everyone first had to declare that they are qualified to vote. While being on the National Register of Electors in error is not an offence under the Canada Elections Act, it is an offence to vote when you are not eligible to do so. Individuals who break the law can face fines and imprisonment.
The federal electoral process has many safeguards, including measures that keep voter registrations accurate and up to date. We continuously work to ensure that only the names of Canadian citizens appear on the Register and on lists of electors. To make sure that those who are registered are eligible, Elections Canada maintains the National Register of Electors using data from Immigration, Refugees and Citizenship Canada to confirm the citizenship of those on the register, and we remove the names of those confirmed to be non-citizens.
Any potential occurrence of illegal voting identified is referred to the Commissioner of Canada Elections who is responsible to investigate.
Any Canadian non-citizen receiving a voter information card should call the local Election Canada office, mentioned on the card, to have their name remove from National Register of Electors. They can also find the contact information of the local Elections Canada office by entering their postal code in the Voter Information System.
