温哥华常识:遇到警察时,您该怎么做

以下是我们在最近的免费法律讲座上摘录的一些注意事项。我们很荣幸的邀请到位于温哥华Henshall Scouten 律师行的Matthew Jackson 律师来告诉大家当在不同情形下,遇到警察时, 哪些是您应当做和不应当做的事情。
当遇到警察时,您该怎么做呢?
很多时候当人遇到跟警察交涉的情况时,都容易恐慌,说出一些会牵连到自身的话。
很重要的是知道警察必须遵循一套规则来与公民交涉,就算是警察也不可以侵犯公民的权利。另外,如果是警察违反了您的权利而取得的证据, 是不能成为呈堂证供的。在一些极端的案例中,整个案子甚至会被法庭推翻,如果证据是非法取得的。

当您跟警察交涉的时候,态度要谦恭有礼,因为如果除了交通违规以外,您没有其它过错,警察很有可能对您宽松处理。不要对警察生气,而且在任何情形底下都不应威胁警察。如果警察感觉到您有威胁性,他/她有权去制伏你。
以下是我们的客座律师根据一些跟警察交涉的特殊情况给予的建议
您应如何应对当警察要求您将车停靠在路边时?
您应留在车内等警察过来。除非警察要求,不要擅自下车。
他有权去要求查看您的驾照、保险跟问您相关的问题,您不能拒绝回答。
交通违章 – 即使警察认为您犯了交通违规,他不是必须给您开罚单;他可以选择对您提出警告。这是个您不要向警察发脾气的好理由,因为警察很有可能放您一马,只给您口头警告。
酒精呼气测试 – 如果警察问您是否喝过酒,而您的回答为是,那么您就立刻给了警察要求您做酒精呼气测试的权利。如果您说不是,那么他只能在有其他合理怀疑您喝酒的证据下要求您做测试,例如不稳定的驾驶行为,您眼睛泛红或是您呼吸之中散发出酒味。
一但警察要求您做酒精呼气测试,您有权要求私下给律师打电话。一旦警察给予您与律师沟通的权利后,您必须照警察指示提供呼气样本。拒绝警察的要求可能导致另一项指控。
如何跟警察应对当他们出现在您的门口
警察在两种情形下有权进入您的房子:
1. 他有搜查令
2. 紧急情况(例如: 有人打了911报警说有人可能在您家中遇到危险)
在以上两种情况以外,您有权拒绝警察进入您的家中,也就是说,他唯一能进入屋内的一个办法是当他得到您的许可。如果您认为他进入您的家中会对您不利,您应该拒绝让他入内而且只在屋外回答警察的问题。
就算警察在紧急情况下进入了您的屋子,他也没有权利搜查房屋,除非他有搜查令。
如何在公众场合与警察应对

当警察过来时,要有谦恭有礼。再次提醒,不要对警察发火还有让他们感觉您具有威胁性。当他们感觉您是个威胁时,他们有权采取任何他们觉得适当的手段制伏您。
通常来说您应该回答警察的所有问题,除非您觉得回答以后您可能会有麻烦。
要特别注意的是如果警察认为您拥有对刑事调查相关的信息,您必须回答对这个案件相关的问题。这种情形下,如果您拒绝回答警察的问话,会被认为是妨害司法。
如果您被质询而您认为您可能会有麻烦,您有权保持沉默,因为您说的每句话将来都可以被用来对付您。
当警察逮捕您的时候,该怎么做?
如果您被逮捕了,警察有权给您带上手铐、搜身还有搜查您的物品。所有警察找到的东西都可以被视为证据用来对付您。要记住您的所有回答都会在之后以书面报告提交。整个问话的过程都有可能被以录音或是录像的方式记录下来。
根据法律,当警察逮捕您的时候,他们必须告知您,您的权利。
当您被带到警察局时,您应该怎么做?
视您被指控的严重程度而定,警察有可能扣留您数小时甚至数天。
当被带到警察局时,您有权给律师打一次电话。在电话中,您可以要求律师前来警察局。如果您没有聘请律师,您有权给某人打电话咨询意见,而在这期间,某人可以帮您请到一个律师。
当您跟律师联系上时,律师要求您的第一件事很可能是不要跟警察说任何话。
警察受过审讯技巧的训练,他们很善于让您开口说话。没有律师在场,您最好不要发言。就告诉警察您不想跟他们谈话而且您想回去自己的牢房。这样做能帮助缩短审讯的时间。
如果您觉得有些话必须告诉警察,最好是通过您的律师告诉他。因此,当律师不在场时,最好的策略还是什么都不要说。
如果您觉得您被错误地逮捕跟拘留了,而且您的权利受到了损害,您有权告那个警察。例如,你感觉到警察没有充分理由对您作出脱衣搜身了,您可以告那个警察。
当您被警方拘留,警方必须保证您不会受到人身伤害,否则您可以投诉他们。
即使在警察必须对您使用武力的情况下,他们只可以采取合理的武力。在一些情形下,如果您觉得采取了过当的武力,您可以控告警察。然而在这样做之前,您应该先咨询过您的律师。

What should you do when confronted by the police?

Oftentimes a person panics when confronted by the police and says something which might be self-incriminating.

It is important to know that the police have to follow a set of rules when they engage a citizen, and that a citizen has rights not even the police can violate. In addition, evidence obtained by the police can be thrown out if such evidence was obtained against your right. In some extreme cases, the entire case against you might be thrown out if such evidence was illegally obtained.

When confronted by a policeman, be polite and courteous to the policeman, if for no other reasons than the fact that he/she might cut you some slack in case you just had a traffic infraction (see further explanation below). Do not get angry at him, and under no circumstances should you ever threaten a policeman. If a policeman thinks that you are a threat, he has the right to subdue you.

Below are suggestions by our guest lawyer on how to engage the police under specific circumstances.

How to interact with a policeman when pulled over while driving

Stay in the car and wait for him/her to approach. Do not get out of the car without being first asked to do so.

He has the right to ask for your IDs, insurance papers and ask other relevant questions which you cannot refuse to answer.

Traffic violations – a policeman does not have to issue you a ticket even if he thinks you had committed a traffic violation; he could choose to give you a warning instead. That is a good reason not to lose your temper in the likelihood that he might decide to let you off the hook with only a verbal warning.

Breathalyzer tests – if a policeman asks you whether you had any alcohol to drink and you answer yes, then that gives him the right to put you through a breathalyzer test right away. If you say no, he can put you through such this test only if he has other reasons to justify the request (e.g. erratic driving behavior, your red eyes, or the smell of alcohol in your breath, etc.).

Once a demand to blow into the breathalyzer is made by the policeman, you must be given the right to talk to a lawyer and do so in private. When this rule is followed, you must provide breath samples as instructed by the policeman. Refusal to do so can lead to another charge.

How to interact with the police when they show up at your doorsteps?

A policeman has the right to enter your house under two circumstances: (1) if he has a search warrant, or (2) in an emergency situation (for example, someone called 911 saying someone might be in danger inside your house).

Failing (1) or (2) above, you have the right to refuse him entry into the house. When he asks whether he can enter your house and you say yes, then, and only then, can he enter your house. If you think he is there against your interest, you should refuse to let him in and answer questions from him outside the house.

Even if the police enter your house due to an emergency situation, they still do not have the right to do a house search.

How to deal with the police when confronted in a public area

Be courteous to the police when approached. Again, do not get angry and utter threats at them. If they feel you are a threat, they have the right to subdue you with whatever means deemed appropriate.

A general rule of thumb is that you should answer their questions unless you think you might be in trouble.

It is important to note that if the police think that you possess information which is relevant to a criminal investigation, you have to answer their questions which are related to such a case. It is considered obstruction of justice if you refuse to answer under such circumstances.

If you are being questioned and think you might be in trouble, you have the right to remain silent, as anything you say can be used against you.

What to do when the police arrest you

If you are arrested, the police have the right to put you in handcuffs, conduct a body search or search your belongings. Whatever they find can be used as evidence against you. Keep in mind that your answers to their questions will be later submitted in a written report. There is likely an audio- and possibly video recording of the entire encounter.

When making an arrest, by law they must tell you your rights.

What to do when you are taken into the police station

Depending on the seriousness of the charge against you, the police can hold you in custody for questioning for hours and sometimes even days.

When taken into a police station, you have the right to call for a lawyer once. During your call with a lawyer, you can ask the lawyer to come. If you do not have a lawyer, you can call to speak to someone for advice, during which time the person might be able to find you a lawyer.

When you are put in touch with a lawyer, the first thing the lawyer will likely tell you to do is to not say anything to the police.

Police are trained interrogators and are thus very good at getting you to talk. Without the presence of a lawyer, it is best not to talk to them. Tell them you do not want to talk and wish to go back to your cell. It might help end the interrogation that way.

If you have something to say, it is best to tell it to the police through your lawyer. Therefore, it is best to say nothing when the lawyer is absent.

If you feel you have been arrested and detained wrongfully, and that your right has been violated, you have the right to sue the police. For example, if you feel you have been strip searched without a valid reason, you can sue the police.

While you are in police custody, the police must guarantee that you will not be bodily harmed. Otherwise you can file a complaint against them.

Even if the police have to use force against you, they can only use reasonable force. In some cases you can sue the police if you feel they used excessive force against you. You should consult your lawyer before doing so, however.
